1. Acceptance of Terms

By accessing or using our website or mobile application, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, please refrain from using our services.

These Terms and Conditions (these Terms) constitute a legally binding agreement between you and Sicons Cooling Limited (Vukapro), a limited liability company registered in Kenya having its MAIN OFFICE GHHJSD Centre, Karen - Opposite Galleria Mall, P.O Box 12345 - 00100, Nairobi - Kenya, governing your use of the Vukapro platform.

Vukapro’s websites (the Sites), mobile applications (the Applications), and content, products, related services, information, and communication are collectively known as the Vukapro Platform.

The use of all personal data you submit to the Vukapro Platform or which we collect about you is governed by our privacy policy (Privacy Policy). A copy of our privacy policy is available here. You acknowledge that by using the Vukapro Platform you have reviewed the Kazi Platform Privacy Policy.

Your consent at registration and continued use of the Vukapro Platform constitutes your acceptance of and agreement to all of the terms and conditions in these Terms and Conditions, Code of Conduct, and the Privacy Policy as well as any future amendments and additions to this Agreement (as hereinafter defined) as we may publish from time to time.

Once you provide your consent at registration, you may change your mind and withdraw consent at any time by contacting us at support@vukapro.com, but that will not affect the lawfulness of any processing carried out before you withdraw your consent.

Vukapro may amend the terms related to the Vukapro Platform, and such amendments will be effective upon Vukapro’s posting of such updated Terms and Conditions. Your continued access or use of the Vukapro Platform after such posting constitutes your consent to be bound by the Terms and Conditions as amended.

If any future changes to this agreement are unacceptable to you or cause you to no longer be in compliance with this agreement, you must deactivate your account and immediately stop using the Vukapro platform.

If you do not agree to be bound by this agreement and abide by its terms, you may not use or access the Vukapro platform.

By acknowledging the terms and conditions and/or using the Vukapro platform, you expressly acknowledge that you have read, understand, and agree, without limitation or qualification, to be bound by this agreement and accept all of its terms.

These terms expressly supersede prior agreements or arrangements with you. Vukapro may immediately terminate these terms or any services with respect to you or generally cease offering or denying services or any portion thereof at any time for any reason.

2. Intellectual Property

All content, logos, trademarks, and intellectual property displayed on our website or mobile application are the property of VukaPro and protected by applicable copyright and intellectual property laws. You may not use, reproduce, distribute, or modify any of our content without our prior written consent.

3. User Conduct

When using our services, you agree to abide by all applicable laws and regulations. You must not engage in any unlawful, harmful, or abusive behavior, including but not limited to:.

  • Violating the privacy or rights of others
  • Uploading or transmitting any harmful or malicious content
  • Attempting to gain unauthorized access to our systems

4. Privacy Policy

Our privacy policy governs the collection, use, and disclosure of personal information provided by users of our website or mobile application. By using our services, you consent to the collection and use of your personal information in accordance with our privacy policy.

5. Responsibilities and Measures for Service Providers on VukaPro Platform

Service providers affiliated with VukaPro are not considered direct employees. As a result, any damages resulting from negligence or criminal acts will be the responsibility of the service provider.

However, VukaPro is committed to ensuring that all providers undergo a thorough vetting and screening process to verify their qualifications for specific job requirements.

Furthermore, VukaPro strives to train all providers in best practices and integrity to maintain high standards of service.

To mitigate any issues, VukaPro has implemented measures such as banning errant providers from accessing job requests and, in severe cases, pursuing legal action to recover damages.

VukaPro provides professional indemnity insurance coverage for jobs on a termly basis.

In compliance with government regulations, VukaPro collects a 10% income tax on behalf of the Government of Kenya (GOK). Therefore, each provider is required to provide their KRA PIN number and a certificate of good conduct during the registration process.

Additionally, each service provider is expected to provide the contact information, email address, and relationship details of at least one referee who can be contacted in case of any concerns or issues.

6. Booking Fees and User Satisfaction

In order to provide transparent information to our users and ensure their satisfaction, we have established a booking fee structure for Tier 1 and Tier 2 services. Please take note of the following details:

Tier 1 Services:

  • Booking Fee: Ksh. 500

Tier 2 Services:

  • Booking Fee: Ksh. 250

We understand the importance of finding the right service provider, and to facilitate this, we have implemented a user-friendly approach. The booking fee will not be deducted until the user has found the ideal match with a service provider. Users will have the opportunity to review provider profiles, make informed decisions, and proceed with the booking process confidently.

Our aim is to prioritize user satisfaction by ensuring transparency and empowering users to choose the best service provider for their specific needs.

7. Third-Party Links

Our website or mobile application may contain links to third-party websites or services. We do not endorse or have any control over the content or privacy practices of these third-party sites. We recommend reviewing the terms and privacy policies of any third-party sites you visit.

8. Limitation of Liability

To the fullest extent permitted by law, VukaPro shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website or mobile application. We do not guarantee the accuracy, completeness, or reliability of any content or information provided.To the fullest extent permitted by law, Wire Tech Solutions shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website or mobile application. We do not guarantee the accuracy, completeness, or reliability of any content or information provided.

9. Indemnification

You agree to indemnify and hold VukaPro harmless from any claims, losses, liabilities, or expenses arising out of your use of our services or any violation of these terms and conditions.

We reserve the right to modify or update these terms and conditions at any time without prior notice. It is your responsibility to review these terms periodically for any changes. Continued use of our services after any modifications shall constitute your acceptance of the revised terms.

11. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Kenya.

12. Acknowledgement and Consent

I hereby acknowledge that I have read and understand the foregoing terms of service, as well as the privacy policy, and agree that my use of the Vukapro Platform is an acknowledgment of my agreement to be bound by the terms and conditions of this agreement.
